    pt I think it’s “guilty of defrauding investors, not guilty of defrauding patients” that people are objecting to.

      pt Probably worth a discussion of the standards for legal culpability — I would bet that the investor fraud didn't require mens rea, the patient fraud did.

        pt Same problem with things like shoplifting vs wage theft — one is strict liability (if you did it, you’re guilty) and the other is not (you have to prove intent or negligence)

          pt (This is the same problem with the Kyle Rittenhouse verdict — it was *correct* but the underlying self-defense laws and the way they allow judicial discretion in when they can be used are problematic)
